Laws Addressing Sexual Harassment in India

BNSS Provisions (Replacing IPC):

• Section 354: Assault or criminal force to outrage modesty.

Protection of Children from Sexual Offenses (POCSO) Act, 2012

Protection for women against harassment at workplaces.

BNSS Rules for POCSO:

Steps to File a Sexual Harassment Complaint

1.Approach a Magistrate: File a private complaint under Section 208 of the BNSS.

2.Superior Officers: File a written complaint with the Superintendent of Police or higher officials.

3.Superior Officers: File a written complaint with the Superintendent of Police or higher officials.

4.Superior Officers: File a written complaint with the Superintendent of Police or higher officials.

Bail in Sexual Harassment Cases

If Police Refuses to File FIR under BNSS

 Anticipatory Bail (Section 467 of BNSS):

• Can be sought if the accused apprehends arrest.

• The court considers the gravity of the offense and the accused’s past record.

Regular Bail (Section 468 of BNSS):

Granted post-arrest upon ensuring that the accused does not tamper with evidence or intimidate witnesses.
